Slides of Zones 2L, 3L: The Rock Limestone retaining wall of 1986 at #64. On trial date 20/8/2021 magistrate ordered the structural engineer report be used for judgement of the following disputes:
a. Whether the retaining wall is needed?
b. If retaining wall is needed, why type?
The structural engineer first report states the owner #62 has piled 400mm sand behind the white brick screen wall [Zone 7L] which is joint to their house. Therefore the term Screen brick wall is used in report of structural engineer [it is not a boundary wall nor it is a dividing fence line].

Zone 4L Slides and LS1 Retaining wall, LS2 Retaining wall, at #64. These two zones on 1/8/2005 did not have retaining wall but sand on #64 was high enough to expect a retaining wall from past there. Extra sand at #64 were removed in 2008 to make the bent dividing fence stable.

File s1045375...is from Engineer Ahmad who is a structural engineer at Structerre. He attended boundary #62 & #64 and based on order of magistrate and defendant's lawyer prepared an engineer's report. What is important in his report:
a. Zone 1L at #62 is piled by sand. The recorded 400mm for height of piled sand is not relevant to the orders made my the magistrate on trial 20/8/2021, therefore engineer Cooper of #64 drew all files in this web page specially DR2 in file D5. See pleat 1 in this accordion and open file D5.PDF. Then see Drawing DR2 in that file. This way you can see a more accurate figure for sand height at #62 Zone 1L, Maximum pile of sand above natural ground level which is coincident with sand height next to boundary at #64 in Zone 1L in same section A-A. Engineer Ahmad stated in his report that each party who is going to do the work for a retaining wall can approach Structerre for further advise and his report is not for drawing it is for determining whether the retaining wall is needed, if yes, what type, only. The claimant's conception of the structural engineer's report is misconception because they want quickly build the same type Aluminum plinth, which prevents the sand of being washed into neighbor's land. The rules of the Minister for commerce is retaining wall design needs to be based on Australian standard codes and it should be designed by a structural engineer. Fence quote for aluminum plinth of colorbond is not enough. Therefore the draft 1 of mechanical engineer's drawings as the following sets were drawn by Engineer A. Cooper, M.F.Gordon [2 drawings]licensed surveyor], also Structerre [1 drawing]:

Previous versions of Drawings D5, D6 drawn by Engineer Afsaneh Cooper had to be revised on 8/6/2022. Therefore, in viewing a drawing, you must check with this engineer A.Cooper to make sure you are looking at the updated drawing which should be 8/6/2022 or after this date. Engineer J. Tick ignored drawing DR11 because that drawing was prepared in general and was not prepared for application for planning and building. |

Section D-D in LS1 and LS3 ret.walls in Zone 4L [for details] Date: 23/06/2022 Time:30 Hours Hourly rate:$60 Drafter: Engineer Afsaneh Cooper Attachments: DR30, Shortage of 700mm sand in compared to Natural ground level in Zone 4L in 1987 was compromised by building an inadequate 440mm high brick wall in Zone 4L which was demolished by second owner [Desai] of #62 for a bid to get a free Twinside ret.wall and a free Limestone remedial retaining wall in Zones 9L, 10L in fortnight after 9/7/2005 abusing owner of #64 mentally by threat of $88,000 legal cost in ongoing defense against 4 rational claims of cost for dividing fence cost and retaining walls cost paid by owner #64, the owners of #62 had to settled by their RAC Building insurer lawyer agreeing with IAL/SGIO Lawyer of owner #64 on 3/09/2008 Deed of Release. All 4 cases against owners of #62 which 2 had been closed before date of this Deed and 2 were closed on the Deed Date, were closed and terms and conditions were set for future claims of all 6 parties in relation to future claims and pleading, one being prejudice, second being "not disclosing correct information", 3rd being claiming about matters arisen from the matters closed on Deed time of 3/9/2008, etc. Owners of #62 breached the above terms and conditions on 25/06/2020 in their Form 53 case FR/GEN/645/2020 and in same case in their Form 32A, March 2021, Form 23 of 16/12/2021 and Form 24 of March 2022. As a result all their Forms except Form 53 and Form 32A were dismissed and their proposed Aluminium retaining wall of their Form 53 also was rejected in Oct 6, 2021 by Structerre Ahmad Nazri associate engineer and Shane Just structural engineer and on 8/6/2022 by Aprodem Structural Engineer. The remaining of their Form 53 for Colorbond fence being rejected by owner of #64 is going to be judged by magistrate on hearing 27/07/2022. No retaining walls orders are going to be issued in case FR/GEN/645/2020 as the costs for the retaining wall + Dividing Fence must be under $10,000 which is not. ______________________ |
